Butte County Reaches Settlement With Man Who Accused Jail Guards Of Assault

Butte County has reached a legal settlement with a man who accused jail deputies of assault. 

The county and the medical provider for the county jail agreed to pay former inmate Cody Pettigrew a total of $90,000 to settle a lawsuit he filed last year. 

Pettigrew alleged that while he was in custody in November 2019, deputies struck him on the head and dragged him down a flight of stairs after he suffered a seizure.

Pettigrew also alleged that the jail’s medical provider, Wellpath, failed to provide medication after he told a deputy he anticipated having a seizure.

 

He claimed deputies said he was faking his seizures.

 

The incident allegedly happened shortly after Pettigrew was booked into the jail on gun charges. He is currently serving a five-year state prison term for shooting at an occupied vehicle.

 

According to the settlement agreementButte County provided to NSPR, the county and Wellpath deny all allegations in Pettigrew’s lawsuit and deny all liability related to the claims.

 

In light of the settlement agreement, Pettigrew and the county this week asked a U.S. District Court judge in Sacramento to dismiss the case.
